These Terms of Use ("Terms") govern your use of the Inkling mobile app ("the App"), provided by Vi Truong Le ("we," "us," "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
Inkling is a private "shared sketchbook for two." You pair your device with one other person's device using a 6-character code, and you draw and share doodles and a mood status inside your own shared space. There is no public feed, no discovery of other users, and no way for anyone outside your pair to browse your space.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own personal, non-commercial use, subject to these Terms.
Anything you draw, type (such as your display name), or set as a mood status inside the App is your content. You are solely responsible for your content and for having the right to create and share it. By using the App, you confirm that your content is your own original work (or that you otherwise have the right to share it), and that it does not infringe anyone else's copyright, trademark, privacy, or other rights.
Copyright / intellectual property complaints. Inkling is not a public hosting or publishing platform — content you create is synced only to the one partner you pair with, not published or made searchable to anyone else. If you believe content shared through the App infringes your copyright or other rights, contact us at tremainejerde8549@icloud.com with a description of the content and your rights, and we will investigate and take appropriate action, which may include removing the content from our database.
You agree not to use the App to:
A shared space is accessible to any device that has its pairing code. You are responsible for keeping your pairing code private and sharing it only with the person you intend to pair with. We are not responsible for access gained by someone who obtains your pairing code, however that happens.
Leaving a space from the App unpairs your device but does not remove your content from the space's history, which may remain accessible to a still-paired partner. See our Privacy Policy for details on deleting a space's content entirely.
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any synced content will be preserved indefinitely or without loss.
To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of the App, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the App will not exceed the amount you paid us for the App in the twelve months before the claim arose (which, for most users, is zero, as the App does not currently sell any purchases).
We may suspend or discontinue the App, or any part of the backend service it relies on, at any time. You may stop using the App at any time by deleting it from your device.
We may update these Terms from time to time. We will update the "Effective date" above when we do. Continued use of the App after an update means you accept the revised Terms.
These Terms are governed by the laws applicable in the developer's place of business, without regard to conflict-of-law principles, except where applicable local consumer-protection law requires otherwise.
